18 Months For Mail Order MP3 Pirate

At Chester Crown Court yesterday, Judge Huw Daniel sentenced Richard Durose to 18 months in prison after he pleaded guilty to conspiring to defraud music companies.

His wife Mrs Durose, who also pleased guilty received a nine month prison sentence suspended for two years. The Duroses were also ordered to pay court costs of Ł14,400.

The court heard that following investigations conducted by record labels' body the BPI and Trading Standards officers, it was discovered that the couple were manufacturing and selling CD-R copies of mp3 recordings by mail order and at computer fairs throughout the UK.

The Duroses had a huge catalogue of MP3 compilations which was updated weekly via email – and at one point their illegal run business was selling multiple album CDs, with 2,000 plus units generating over Ł13,000 per month.

On sentencing Mr Durose, Judge Huw Daniel said:
"This was a substantial fraud and involved the theft of other people's efforts, namely the producers of the music and in the public interest I have determined that a prison sentence is appropriate."

David Martin, BPI Director of Anti Piracy stated,
"This is an effective sentence which should serve as a deterrent to other would-be music pirates. If you break the law and infringe music copyrights you will be caught and prosecuted."
