German IFPI Wants To Delete Hyperlinks To Napster.com
We at gnutella.de and some other operators of mp3-websites (mpex.net, zdnet.de, mp3-world.net ..) got an email from Clemens Rasch on last friday, he is an attorney of german IFPI. He wants us to delete all hyperlinks to the website of napster.com till Saturday Jul/29/2000. I'll attach a copy of the mail and an english translation. All operators decided not to follow this request. We think it is an intimidation attempt of german IFPI. The form of the text is unusal. Next to some spelling mistakes, the subject sounds "Internet Homepage mit unautoriserten Musikaufnahmen", "Internet homepage with illegal music-recordings", none of us do host or link such content. In an other part of the mail he wrote mp3.com instead of napster.com. It seems to be a very unorganisied and uncoordinated action from Mr. Rasch. He threatens with further juristical steps. Internet homepage with unauthorized music accommodations Dear Mr. Lars Gollnow, the IFPI (international Federation OF the Phonographic Industry) is the world-wide union of the tone carrier manufacturers. In our German regional committee almost all tone carrier manufacturers of the Federal Republic of Germany (at present approximately 380 member firms) are united. To our statutory functions the perception of all parallel interests of the members, in particular also the Piraterieverfolgung (=fight against piracy) belongs. In co-operation with our international sister organizations music contents not-authorized by us regularly Internet is checked for. With the fact we stated that on your server under the URL http://gnutella.de / the service of the company Napster.com is made accessible. As you will have inferred from the medium publications, district forbade the court in San Francisco, to California the service of MP3.com by provisional order, because by the spreading exercising artists at these accommodations, connected by music accommodations the author and rightright rights of our member firms are violated and them. Also the mobilization of funds of the service of Napster.com by hyperlink is on the right-hurting. We has to request you to delete or delete let to 29,07,00 17:00:00 under the URL specified above together with their Untersites (=subpages) of available made on the right-hurting supplies to speeren and from your server. We assume also you do not have interest to provide for illegal supplies on its server workstation. For the sake of the good order wise we it on the fact that our member firms will switch immediately an attorney on, if you do not give the required blocking to distinguished and no information. Further legal steps remain reserving. Yours sincerely Clemens Rasch -Justitiar -
